Terms of Service

Effective date: March 20, 2025

Article 1 (Purpose)

Echostone Inc. ("Company") operates the Echostone service ("Service").

By using the Service, you acknowledge and agree that these Terms, the Privacy Policy, and the Location-Based Services Terms have legal effect.

Article 2 (Definitions)

Terms not defined herein are defined by applicable laws and the Company.

  1. "User" means all paid, free, and non-member users of the Service.
  2. "Service Registration" means applying to use the Service.
  3. "Educator Account" means a special account that can create and manage student accounts.
  4. "Student Account" means an account created by an Educator Account to use the Service.

Article 3 (Posting and Amendment of Terms)

  1. The Company posts these Terms on the service screen. They apply to all users who agree.
  2. The Company may amend these Terms as permitted by law. Amendments take effect upon posting.
  3. These Terms may change. Changes are posted at least 7 days (30 days for unfavorable changes) before taking effect.
  4. Users may terminate if they disagree with changes. Continued use within 30 days of the effective date constitutes acceptance.

Article 4 (Echostone Service)

  1. The Company may modify the Service at any time for operational or technical reasons.
  2. Users are responsible for their content. The Company may remove content that violates these Terms without notice.
    • Illegal purposes
    • Defamation of others
    • Content violating public order
    • Criminal activity
    • Copyright or other rights infringement
    • Obscene content or links
    • Unauthorized commercial advertising
    • Irrelevant content
    • Unduly interfering with business
    • Disrupting or damaging the Service
    • Unauthorized access to other accounts
    • Other violations of law

Article 5 (User Obligations)

  1. Users must protect personal information and not disclose it to third parties.
  2. Subject to compliance, the Company grants users the right to use the Service.
  3. Users must not interfere with Company operations.
  4. Users must not engage in the following:
    • False information in registration
    • Posting obscene or violent content
    • Resale, transfer, or commercial use without permission
    • Modifying the Service or creating derivatives
    • Unauthorized access (including modified or third-party software)
    • Connecting to other platforms or manipulating the Service outside its intended use
    • Reverse engineering, decompiling, or copying the Service without permission
    • Running automated programs that burden or degrade the Service
    • 기타 관련법령에 위반된다고 판단되는 행위

Article 6 (Loss of User Eligibility)

  1. The Company may suspend accounts that violate these Terms or disrupt the Service.
  2. The Company may permanently suspend accounts for serious violations. Benefits will be forfeited with no compensation.
    • Identity theft, payment fraud, phone/business impersonation
    • Copyright infringement, illegal software, service disruption
    • Violations of the Information and Communications Network Act
    • Exceeding user authority
    • Other legal violations
  3. Users may appeal restrictions. The Company may restore access if the appeal is upheld.

Article 7 (Limitation of Liability)

  1. The Company is not liable for service outages due to force majeure.
  2. The Company is not liable for outages caused by user fault.
  3. The Company is not liable for network-related issues.
  4. The Company is not liable for accuracy of user-provided information.
  5. The Company is not liable for disputes between users.
  6. The Company is not liable for transactions between users or with third parties.
  7. The Company is not liable for connection or usage issues.
  8. The Company does not guarantee the Service is free of errors, viruses, or malicious software.
  9. The Company is not liable for third-party illegal access or use.
  10. The Company is not liable except as required by law.

Article 8 (Indemnification)

  1. The Company is not liable for damages except intentional criminal acts.
  2. The Company may claim damages from users who violate these Terms.

Article 9 (Service Changes and Suspension)

The Company may modify or suspend the Service. No separate compensation is provided unless required by the Terms.

Article 10 (Prohibition of Assignment)

Users may not transfer or encumber their right to use the Service.

Article 11 (Privacy Protection and Use)

The Company needs personal information to provide the Service.

See the Privacy Policy for details on collection, use, storage, and transfer of personal information.

  1. The Company collects information to provide quality service and may collect additional information as needed.
  2. Users may view and modify their personal information at any time.
  3. The Company is not responsible for third-party apps or services.
  4. The Company complies with applicable privacy laws.
  5. The Company may provide information to government agencies when legally required.

Article 12 (Disclaimer)

  1. The Company is not liable for service outages due to force majeure.
  2. The Company is not liable for outages or termination due to user fault.
  3. The Company is not liable for third-party network or service availability or quality.
  4. The Company does not guarantee the Service is free of errors or malware.
  5. The Company is not liable for accuracy of user-provided information.
  6. The Company is not liable for lost profits or damages.
  7. 회사는 서비스를 매개로 이용자 간 또는 이용자와 제3자 간에 거래 등에 관련하여 책임이 면제됩니다.
  8. The Company does not guarantee the accuracy of strength tests or learning guides.
  9. The Company is not liable for educator account technical issues. Educators are primarily responsible for student account management.
  10. The Company is not liable for inability to use the Service.

Article 13 (Compensation for Service Outages)

Service outages are compensated by extending the subscription period for the duration of the outage.

Article 14 (Withdrawal and Refund Policy)

Refunds are generally not provided for voluntary withdrawal. Refunds may be possible in the following cases:

  • Major service defects or Company fault preventing service resumption
  • Duplicate payment by the user

Except as above, no refunds for used service or remaining period. Refund requests must be made within 7 days of discovering the issue.

When an educator withdraws, student accounts and their membership periods remain. The educator loses management rights but student access is unaffected.

Article 15 (Re-registration Rules)

Re-registration is allowed after withdrawal. However, note the following:

  • Data from the previous account cannot be recovered. Re-registration starts a new account.
  • Re-registered users are not eligible for new-member promotions.

This ensures fair use. Consider withdrawal carefully; re-registration creates a new account.

Article 16 (Subscription Management and Cancellation)

  1. Subscription start
    • Upon subscription, fees are charged immediately and the period begins on the registration date.
    • Subscription implies agreement to monthly recurring payment on the same date each month.
    • Users must meet promotion or discount conditions.
  2. Subscription changes and cancellation
    • Users may cancel anytime through the "Account & Settings" menu.
    • Cancellation takes effect immediately if before the next payment date. Charged fees are non-refundable.
    • Canceling a promotional subscription may result in additional charges for the discounted amount.
      • Example: For Basic membership, if monthly fee is ₩22,000 (incl. VAT) and regular price is ₩30,000, the ₩8,000 discount may be charged.
      • Example: For Educator accounts with promotional discounts, the same principle applies.
    • Service remains available until the end of the current period; it ends automatically on the next payment date.
    • When an educator cancels, student accounts and their membership remain for the granted period.

Article 17 (Educator Account Special Provisions)

  1. Educators may create unlimited student accounts and are responsible for their management.
  2. Pro and Basic memberships assigned to students remain for the granted period.
  3. When an educator terminates, student accounts and their membership remain for the granted period.
  4. Educators are responsible for student data security and privacy compliance.
  5. The Company is not liable for misuse, unauthorized access, or data breaches of student accounts.

Article 18 (Jurisdiction and Governing Law)

  1. Disputes are subject to the exclusive jurisdiction of the court at the user's address. For foreign residents, the court under the Civil Procedure Act has jurisdiction.
  2. Korean law prevails for disputes.
